Before OSHA and the Coast Guard: Commercial Diving Standards

On June 15, 1976, the Occupational Safety and Health Administration (OSHA) issued an Emergency Temporary Standard (ETS) for commercial diving operations (41 FR 24272).¬†However on August 11, 1976, the U. S. Court of Appeals for the Fifth Circuit issued an indefinite stay of the standard pending a final decision on its validity. (“Taylor Diving and Salvage Co., Inc., et al. v. U.S. Department of Labor,” Civil Action No. 76-2886.) The Court has not yet ruled on the merits of the emergency standard, which was withdrawn by OSHA on November 5, 1976 (41 FR 48969).
