Dear Mr. Patton:
The Council is concerned about the Maritime Administration’s interim rule (45 FR 68393) establishing conditions under which U.S. vessels that have received a construction subsidy (CDS) would be permitted to engage in domestic commerce. In an earlier Notice of Proposed Rulemaking (NPRM) MarAd proposed explicit criteria by which the Secretary of Commerce may rescind permanently a vessel’s domestic trading restrictions. In its comments on the NPRM, the Council urged MarAd to impose no conditions on the entry of existing CDS carriers into U.S. domestic commerce other than the requirement that the carriers pay back an appropriate amount of the CDS…
